NEC3 ECC Payment A: Payment Introduction, Assessing the Amount Due and Payment
This course provides an introduction to the payment process under the NEC3 Engineering and Construction Contract (ECC) and explain the key concepts of Assessing the Amount Due.
On completion of this course you will:
- Find the core clauses that deal with payment
- Know how to set out the process and timescales to be followed regardless of which main option is chosen
- Understand the procedure, its timings and who is responsible for assessing the amount due, certification and payment
An Overview of Payment (Part 2) Payment and Variations
The aim of this course is to explain the key payment rights and obligations under construction contracts and explain how these principles are applied in practice. This course provides some examples on set off, retention and how variations work.
After studying this course, you should be able to;
- Describe how the variations such as changes to the specification of work can affect the mechanisms such as retention and set-off payment.
- Explain the need for variations, outline the definition of variations, limits on the scope of variations, and how to issue variations.
An Overview of Payment (Part 3) Payment and Standard Forms
The aim of this course is to explain the key payment rights and obligations under construction contracts and explain how these principles are applied in practice. This course provides some examples on how variations are valued with cross referencing back the JCT, FIDIC and NEC forms of contract.
After studying this course, you should be able to;
- Explain why when variation is validly issued, the omission, change or extra work needs to be valued.
- Explain how general principles of valuation work with specific examples from JCT and FIDIC and NEC.
NEC4 Payment Final Assessments
This short course looks at two payment features that were introduced to the 4th edition of the Engineering and Construction Contract. These are the final assessment provisions which apply to all main options and progressive finalisation of Defined Costs under main options C to F.
After studying this course, you should be able to:-
- Learners will therefore have much greater knowledge of what they have to do, in their role, to administrate the payment provisions of the NEC4 Engineering and Construction Contract (ECC) correctly.
NEC3 ECC Payment Certificate
Use this free downloadable template to help you create a payment application and certificate under the NEC3 Engineering and Construction Contract (ECC).
Payment on construction projects is usually regulated by legislation. You must check which legislation applies in your jurisdiction to ensure these templates are suitable.
You can use these NEC3 ECC templates for the Contractor's application for payment and the Project Manager's certificate as follows:
- Contractor's application for payment under clause 50.4
- Project Manager's Payment Certificate under clause 51.1
- Notify under clause 51.2 of interest on a corrected payment certificate
- Notify under clause Y2.3 of an intention to pay less than the notified sum
- Notify under clause Y2.4 of an intention to suspend performance
